CrediMax shall, at the request of the cardholder, issue an e-Statement to the email specified by the cardholder on the terms and conditions set out herein. Please note that the Service (as described herein) is subject to the applicable laws, bylaws and regulations of the Kingdom of Bahrain as may be amended or re-enacted from time to time. Any unauthorized use of the Service is strictly forbidden.
"CrediMax" means CrediMax B.S.C. (closed)
"Card" means the credit/prepaid/charge card(s) bearing the service marks of the respective card association (Visa, MasterCard or JCB) issued by CrediMax to the Cardholder; including supplementary cards.
"e-Statement" means the monthly electronic statement sent in PDF format to the Principal Cardholder by email;
"Terms and Conditions"means these terms and conditions for using and/or registering to the e-Statement Service, as may be amended from time to time;
"Cardholder" means any person who uses a Card issued by CrediMax;
"PIN" means the four digit PIN number necessary to access the PDF file to view the e-Statement.
"Principal Cardholder" or "You" means a person in whose name a Card account is issued and maintained.
"Supplementary cards"means cards nominated under by the principal cardholder card account and where the transactions charged are chargeable to the card account of the principal cardholder.
2. Description of the CrediMax e-Statement Service
2.1. The e-Statement Service delivers Card statements to the Cardholder electronically through e-mail. The e-Statements will replace the paper statements mailed to you with an electronic PDF version which can be viewed, saved and/or printed on your computer. Once the Service is provided, CrediMax will immediately and automatically cease to provide you with the printed and mailed statements.
2.2. No statements can be obtained through the e-Statement Service for months prior to the e-Statement registration date.
2.3. The Service is only available to the "Principal cardholder"
2.4. All supplementary accounts held by the same Principal Cardholder shall be bound by his/her decision to register or cancel the e-Statement Service.
3. How to register for CrediMax e-Statement
3.1. To enjoy the e-Statement Service, you must be an existing CrediMax Cardholder, and must accept these e-Statement Terms & Conditions and provide your email address. However, corporate cardholders can submit a formal request to CrediMax Corporate Department on the following addresses: CrediMax P.O Box 5350 Manama Bahrain. 3.2. The e-Statement Service shall be available to all CrediMax Cardholders, except Prepaid Gift Cards.
4. Effective date
This Service will be effective from the date of registration for the CrediMax e-Statement Service. CrediMax shall use it reasonable endeavors to send the e-Statement to the email address by the next statement production date. However, you acknowledge and understand that the registration for the e-Statement Service may not take effect immediately subject to the processing times of such request.
5. Access to e-Statement
A monthly e-Statement will be sent to the email address provided by the Cardholder in a PDF format. The Cardholder will be prompted to input his/her PIN to access the PDF file. Once access has been granted, you will be able to view, save and/or print the current month's e-Statement.
6. Obligations of Cardholder
6.1. You shall take all necessary security measures and precautions to ensure that the email address is not accessed by any unauthorized party.
6.2. You shall not disclose the PIN to any person and shall be responsible for the use, confidentiality and protection of such PIN.
6.3. You must immediately communicate to CrediMax any changes to your email address in writing or by calling 00973 17117117. CrediMax shall not be responsible for your failure to update your account details.
6.4. You acknowledge that you shall use the e-Statement Service responsibly, and shall not use the e-Statement Service for any fraudulent or illegal purpose, or to interrupt or damage the Services of CrediMax in any way, or to otherwise make them less efficient.
6.5. You shall not use the Service to cause inconvenience, offence or disruption to CrediMax or its staff.
6.6. You shall immediately notify CrediMax of any suspicions that the details of the e-Statement are compromised or otherwise known to a third party. Including but not limited to ( card number , card details and card balance details )
6.7. You must immediately and without delay provide CrediMax with any and all information and/or documents requested.
6.8. You shall not (whether directly or indirectly) re-engineer, modify, disseminate, copy and/or decompile any software found in the system or which is otherwise owned or provided by CrediMax.
7. Objections to e-Statements
7.1. e-Statements shall be conclusive evidence of the Card(s) account, including all transactions made using the Card(s), the amounts to be paid and the amounts outstanding.
7.2. Should you notice or become aware of any unauthorized transactions or amounts on the e-Statement, you must immediately notify CrediMax and in any event no later than15 calendar days from the date of the e-Statement to contest to such transactions or amounts, failing which you shall have no right to object to the amounts set forth therein.
7.3. You shall be responsible to ensure the frequent checking of your email and review of your e-Statement. You shall be deemed to have received and read all e-Statements sent to you on the day the e-Statement is sent by CrediMax.
8. Disclosure and Security
8.1. Information you provide in connection with the e-Statement Service will be stored on CrediMax's secure servers and shall be protected by certain technical security measures including high standard encryption techniques.
8.2. CrediMax will use its best endeavors to ensure the security of the information conveyed through the e-Statement Service. Notwithstanding the foregoing, CrediMax shall not be liable in any manner for any disruption, unavailability of the service, communication, electrical or network failure that may result in the e-Statements being incomplete, unavailable or delayed in transmission.
8.3. Despite the security measures undertaken by CrediMax, CrediMax does not warrant the timeliness, security, confidentiality and/or availability in the transmission of the e-Statement sent to the email address. Therefore CrediMax shall not be held liable for any errors, internet malwares, viruses and/or inaccuracies.
8.4. CrediMax will never make any request to you to provide any account or security information via email. You shall be responsible for any damage caused as a result of the provision of any account or security information by email.
9. CrediMax Limitation on Liability
9.1. CrediMax will not be responsible or liable, and you agree to indemnify and hold CrediMax harmless, for:
9.1.1. the incidental or consequential damages that may result from unauthorized access to the e-Statement or email address;
9.1.2. any failure to perform the obligations prescribed herein due to an event beyond CrediMax's control, including but not limited to communication errors, failure of the internet system, network issues, computer failure, software and/or hardware problems, email related problems and internet malfunctions. In such event, CrediMax shall use its best endeavors to restore the service as soon as is reasonably possible;
9.1.3. any errors, viruses, delays, inaccuracies, losses, and/or damages whatsoever arising from or in connection with your use of the e-Statement service, including but not limited to any interception, modification, amendment, disruption, interruption, delay or inaccuracy of emails or internet transmission or any other communication equipment or facilities.
9.1.4. any damage caused by your failure to update or modify your software or hardware to ensure proper access to the e-Statements;
9.1.5. any consequences that may arise from an online communication between you and CrediMax which may be lost in transmission (whether in whole or in part).
9.2. For the avoidance of doubt, CrediMax shall not be responsible for any losses suffered whether direct, indirect, consequential or special loss in connection with any of the circumstances set forth in Clause 9.1 above, even if CrediMax shall have been advised or notified of the same.
10. Refusal to offer e-Statement service
CrediMax reserves the right to refuse to offer the e-Statement service to any customer or cardholder for any reason at its sole and absolute discretion.
11. Request to cancel the e-Statement service by Cardholder
11.1. The Principal Cardholder may opt to cancel the e-Statement service and return to receiving the card account statements by post at any time by submitting a letter of request to CrediMax by [email, facsimile, post, etc.].
11.2. Upon cancelation of the e-Statement service, CrediMax shall use it reasonable endeavors to send the paper based statement to your last known or recorded mailing address by the next cycle date. However, you acknowledge and understand that the cancelation of the e-Statement service may not take effect immediately subject to the processing times of such cancellation request.
12. Modification and discontinuation of e-Statement service by CrediMax
12.1. Any breach of these Terms and Conditions by you may result in the immediate withdrawal of this service at CrediMax's absolute discretion
12.2. CrediMax reserves the right to modify, add and/or remove any feature of this service in any way at its sole and absolute discretion.
12.3. In some circumstances or upon the occurrence of certain events as determined by CrediMax, CrediMax may send to you the paper based statement of account to your last known or recorded mailing address. In such instance, you agree to accept and view the statement of account in a timely manner.
12.4. CrediMax may without giving any reason, modify, cancel, suspend, discontinue or terminate this service at any time with prior notice to you. In the event of such modification, cancelation, suspension, discontinuation or termination, CrediMax shall revert to sending the statements in paper format to your last mailing address appearing in CrediMax's records.
13. Marketing and Advertising
CrediMax may from time to time market or advertise its products, services and promotions through the e-Statement service channel.
14. Amendment to these Terms and Conditions
14.1. CrediMax reserves its right to amend these Terms and Conditions at any time under its sole discretion, by giving notice in writing to you by such notification method as CrediMax may choose, including mail, facsimile, email notification, publication in local newspapers, posting on CrediMax's website, posting in displays at the CrediMax Head office / branch or otherwise referring to such changes in the monthly statements. Such amendments, deletions and additions shall be effective on and from the date specified in the notice.
14.2. Your continued use of the e-Statement service shall be deemed to be acceptance of these Terms and Conditions, and any amendments made thereto, unless written notice is sent to CrediMax indicating otherwise, upon which the e-Statement service shall be immediately withdrawn. In such event, a request for termination of the service must be made in accordance with Clause 11 above.
CrediMax does not currently charge a fee for the e-Statement service; however CrediMax reserves the right to introduce any such fees in the future in line with CrediMax's prevailing policies. Any such implementation of fees shall be notified to the Cardholder in advance.
16. Terms and Conditions
16.1. These Terms and Conditions shall apply in full and in addition to all other Terms and Conditions applicable to the Cardholder in connection with the Card(s). The provision of all facilities and services offered by CrediMax is subject to the Principal Cardholder's acceptance of all related Terms and Conditions. Non-acceptance or breach of these Terms and Conditions shall result in the immediate withdrawal of the facilities or services.
16.2. In the event of conflict between these Terms and Conditions and any other terms and conditions, these terms and conditions shall prevail to the extent of such conflict.
16.3. If at any time any provision hereof is or becomes illegal, invalid or unenforceable in any respect, neither the, validity or enforceability of the remaining provisions shall in any way be affected or impaired thereby.
These Terms and Conditions are executed in English. In the event of any discrepancy between the texts of any other language, the English language shall prevail.
18. Governing Law and Jurisdiction
The e-Statement Service and these Terms and Conditions shall be governed by and construed in accordance with the laws of the Kingdom of Bahrain and any dispute arising therefrom shall be subject to the exclusive jurisdiction of the courts of the Kingdom of Bahrain.
By registering the e-Statement Service, you confirm that all information provided by you is true and accurate, and that you have read, understood and agree to be bound by these Terms and Conditions.
